Terms and Conditions – Elegance-Cotswolds

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

• Customer: the natural or legal person who enters into an agreement with Elegance-Cotswolds.

• Agreement: a distance contract between Elegance-Cotswolds and the customer.

• Products: all goods offered by Elegance-Cotswolds through its webshop.

• Website: the Elegance-Cotswolds website, accessible via www.elegance-cotswolds.co.uk.

Article 2 – Applicability

These general terms and conditions apply to all offers, quotations, orders, and agreements between Elegance-Cotswolds and the customer.
Before concluding a distance agreement, the customer will be provided with the text of these general terms and conditions.

Article 3 – The Offer

The offer includes a complete and accurate description of the products offered. Elegance-Cotswolds strives to present and describe the products as accurately as possible.
Obvious mistakes or errors in the offer are not binding for Elegance-Cotswolds.

Article 4 – The Agreement

The agreement is concluded at the moment the customer accepts the offer and meets the stated conditions.
Elegance-Cotswolds confirms the customer's order by email.

Article 5 – Right of Withdrawal

The customer has the right to withdraw from the agreement within 14 days without stating any reason.
The withdrawal period starts on the day after the customer receives the product.
To exercise the right of withdrawal, the customer must contact Elegance-Cotswolds via the contact form on the website or by email.

Article 6 – Customer’s Obligations During the Withdrawal Period

During the withdrawal period, the customer must handle the product and packaging with care.
The customer may only unpack or use the product to the extent necessary to determine the nature and characteristics of the product.

Article 7 – Costs in Case of Withdrawal

If the customer exercises the right of withdrawal, they will bear the cost of returning the product.
Elegance-Cotswolds will reimburse all payments made by the customer, including any shipping costs charged by Elegance-Cotswolds, as soon as possible and no later than 14 days after the day on which the withdrawal is communicated.

Article 8 – Exclusion of the Right of Withdrawal

Elegance-Cotswolds may exclude the customer’s right of withdrawal for the following products:

• Products that spoil quickly or have a limited shelf life.

• Products that are not suitable for return due to health protection or hygiene reasons.

Article 9 – Price

The prices of the products are listed in British pounds (£) and include applicable VAT, unless stated otherwise.
Any additional costs, such as shipping fees, are stated separately during the ordering process.

Article 10 – Conformity and Warranty

Elegance-Cotswolds guarantees that the products comply with the agreement, the specifications listed in the offer, and reasonable requirements for reliability and usability.
Any applicable warranties are stated per product.

Article 11 – Delivery and Execution

Elegance-Cotswolds will exercise the utmost care in receiving and executing product orders.
The delivery address is the address provided by the customer to Elegance-Cotswolds.
Elegance-Cotswolds will execute accepted orders as soon as possible, but no later than within 30 days, unless a longer delivery period has been agreed.

Article 12 – Payment

Unless otherwise agreed, amounts due by the customer must be paid within 14 days from the start of the withdrawal period.
The customer is obliged to immediately notify Elegance-Cotswolds of any inaccuracies in the provided or stated payment details.

Article 13 – Complaints Procedure

Complaints about the execution of the agreement must be submitted to Elegance-Cotswolds within a reasonable period, clearly described and in full.
Complaints will be answered within 14 days of receipt.

Article 14 – Disputes

Agreements between Elegance-Cotswolds and the customer to which these general terms and conditions apply are governed exclusively by Dutch law.
In the event of a dispute, the competent court in the place where Elegance-Cotswolds is established shall have exclusive jurisdiction, unless mandatory law provides otherwise.

Article 15 – Changes to the General Terms and Conditions

Elegance-Cotswolds reserves the right to change these general terms and conditions at any time.
Changes will be communicated to the customer in a timely manner and will take immediate effect.

Additional Provisions

Responsibility for Import and VAT:
The customer is solely responsible for fulfilling any import duties, taxes (including VAT), and other charges incurred when importing the goods into the destination country.

Shipping and Delivery:
Ordered goods are shipped directly from a third country (often China). The webshop is not responsible for the import of goods into the UK or any other country. Shipping is handled directly by the supplier from the third country.

Risk of Delays and Additional Costs:
The customer acknowledges that delays may occur due to customs inspections or other import-related procedures. Any additional costs arising from import—such as customs duties, storage fees, or other charges—are entirely the customer’s responsibility. The webshop is not liable for such delays or extra costs.
